Key Employee

In the context of certain fringe benefit plans, an officer or owner (of all or a significant part) of a business whose annual pay exceeds a certain amount. Many benefits offered by employers do not qualify for favorable tax treatment if they discriminate in favor of key employees. In the context of the Family and Medical Leave Act, a high salaried employee who may not be entitled to reinstatement after FMLA leave if doing so would cause the employer serious economic injury.
